When someone has died
A general outline of how deceased estates work in South Africa. Every estate is different, and timelines depend on the estate and the Master's Office.
- The death is reported to the Master of the High Court, with the will (if there is one) and supporting documents.
- The Master appoints an executor through Letters of Executorship, or Letters of Authority for smaller estates.
- The executor notifies creditors, gathers assets and lists debts.
- A liquidation and distribution account is prepared and advertised for inspection.
- Once accepted, debts are paid and assets, including property, are transferred to the heirs.
This is general information, not legal advice. Reserved legal work is done by a qualified attorney.
What happens when there is no plan
These problems usually land on the people you love, at the hardest time.
- No willYour estate is shared under the law of intestate succession, which may not match your wishes.
- Estates frozenBank accounts can be frozen until an executor is appointed, leaving families short of money.
- Children unprotectedWithout named guardians and a plan for their inheritance, decisions may be left to others.
- Property passes badlyWithout planning, property can be hard to transfer, or have to be sold to pay estate costs.
- Trusts set up and forgottenA trust that isn't properly administered may not do what it was set up to do.
- No one knows where anything isMissing documents and policies slow everything down.
